Terms of Service for the Provision of Services by Electronic Means on the growtime.eu website

These Terms of Service set out the rules for the provision of services by electronic means via the website available at growtime.eu, operated by GROWTIME Sp. z o.o. These Terms of Service have been drawn up on the basis of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

§ 1. General provisions and definitions

These Terms of Service define the types and scope of services provided by electronic means, the technical conditions for the provision of such services, the conditions for concluding and terminating agreements for the provision of services by electronic means, as well as the complaint procedure.

Whenever the following terms are used in these Terms of Service, they shall be understood as follows:

§ 2. Types and scope of services provided by electronic means

Via the Website, the Service Provider provides the following Electronic Services to Service Recipients free of charge:

2.1. Browsing the content of the Website

A service consisting in making the content of the Website available to the Service Recipient, including information about the Service Provider, its offer and the products and services offered. The Website is available in the following language versions: Polish, English and Russian. The content of the Website is informational in nature.

2.2. Contact form / request for quotation

A service enabling the Service Recipient to send the Service Provider a message, enquiry or request for quotation via the contact form made available on the Website. Using the form requires providing the data necessary to respond. The data submitted via the form is delivered to the Service Provider in the form of an e-mail message. The form is protected by the reCAPTCHA mechanism provided by Google, used to verify whether the enquiry is sent by a human.

2.3. Technical support ticketing system

A service enabling the Service Recipient to submit an enquiry or issue relating to technical support via the ticketing system available at growtime.uvdesk.com. Ticket handling is carried out using an external ticketing system, which processes the data contained in the ticket for the purposes of its handling.

§ 3. Technical conditions for using the Website

For the proper use of the Website and the Electronic Services provided through it, the following technical requirements must be met on the part of the Service Recipient:

The Website is provided using progressive web application (PWA) technology, which may store some of the Website’s resources in the cache of the Service Recipient’s browser in order to speed up its operation.

The Service Provider informs that the use of Electronic Services provided by electronic means may involve typical risks arising from the use of the Internet. In order to reduce these risks, the Service Recipient is advised to use up-to-date antivirus software and a firewall.

§ 4. Conditions for concluding and terminating agreements for the provision of electronic services

Electronic Services are provided by the Service Provider free of charge.

The agreement for the provision of the Electronic Service consisting in browsing the content of the Website is concluded upon the Service Recipient entering the Website and is of a one-off nature. It is terminated when the Service Recipient leaves the Website.

The agreement for the provision of the Electronic Service consisting in the use of the contact form or the support ticketing system is concluded at the request of the Service Recipient and is of a one-off nature. It is concluded upon commencement of use of the given Service (completing the form or submitting a ticket) and is terminated upon its performance or upon the Service Recipient ceasing to use it.

The Service Recipient may at any time and without giving any reason cease using the Electronic Services by leaving the Website or ceasing to use the given Service.

§ 5. Prohibition on providing unlawful content and rules of use

The Service Recipient is prohibited from providing, via the Website, in particular through the contact form and the ticketing system, content of an unlawful nature.

The Service Recipient is obliged to use the Website in a manner consistent with the law, good practice and the provisions of these Terms of Service, with respect for the personal rights and intellectual property rights of third parties and of the Service Provider.

§ 6. Intellectual property

All content made available on the Website, including in particular texts, descriptions of products and services, photographs, graphics, multimedia materials, the layout and composition of the Website, as well as the GROWTIME trademarks and designations, are the property of the Service Provider or are used by the Service Provider on the basis of appropriate rights and are subject to legal protection.

Use of the Website does not mean that the Service Recipient acquires any rights to the content contained therein. It is prohibited to copy, reproduce, distribute, modify or otherwise use the content of the Website, in whole or in part, without the prior written consent of the Service Provider, except for use within the scope of permitted use resulting from the applicable provisions of law.

§ 7. Liability of the Service Provider

The content posted on the Website is of an informational nature only and does not constitute an offer within the meaning of the provisions of the Polish Civil Code.

Information about products and services presented on the Website, including descriptions of equipment for mushroom farms and engineering services, constitutes an invitation to conclude an agreement (an invitation to submit requests for quotation) and is not a binding commercial offer. The terms of order fulfilment and prices are determined individually on the basis of a request for quotation addressed to the Service Provider.

The Service Provider exercises due diligence to ensure that the content presented on the Website is up-to-date and reliable; however, it is not liable for the consequences of decisions made by the Service Recipient solely on the basis of the information posted on the Website, without prior contact with the Service Provider.

The Service Provider is not liable for interruptions in access to the Website resulting from causes beyond the Service Provider’s control, including force majeure, equipment or telecommunications network failure or maintenance work, nor for disruptions in the use of the Website resulting from the Service Recipient’s failure to meet the technical requirements specified in § 3.

§ 8. Complaint procedure

The Service Recipient has the right to submit a complaint regarding the Electronic Services provided via the Website.

A complaint should be submitted electronically to the e-mail address: info@growtime.eu.

A complaint should contain at least a description of the objections raised and contact details enabling the Service Provider to provide a response to the complaint.

The Service Provider shall examine the complaint and respond to it without undue delay, no later than within 14 days of receiving it. The response to the complaint shall be sent to the e-mail address from which the complaint was submitted, or in another manner indicated by the Service Recipient.

§ 9. Protection of personal data

The rules for processing the personal data of Service Recipients in connection with the use of the Website and the Electronic Services, including information about the data controller, the purposes and legal bases of processing, the recipients of the data and the rights of the data subjects, as well as the rules on the use of cookies, are set out in the Privacy Policy available on the Website.

In all matters relating to the protection of personal data, the Service Recipient may contact the Service Provider at the e-mail address: info@growtime.eu.

§ 10. Final provisions

In matters not regulated by these Terms of Service, the generally applicable provisions of Polish law shall apply, in particular the provisions of the Polish Act on Providing Services by Electronic Means and of the Polish Civil Code.

The Service Provider reserves the right to introduce changes to the Terms of Service for important reasons, in particular in the event of a change in the applicable provisions of law, a change in the scope or manner of providing the Electronic Services, or technical or organisational changes on the part of the Service Provider. The Service Provider shall notify of any change to the Terms of Service by publishing the amended Terms of Service on the Website. The amended Terms of Service shall be binding on the Service Recipient using the Website from the moment they are made available on the Website.

These Terms of Service are effective as of 10 July 2026.

The Polish version of this document is binding; in case of any discrepancy, the Polish version prevails.
